Agreement to Terms

By accessing or using Ewald Music's website, services, or participating in our programs, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

Age Requirements

You must be at least 18 years old to enter into legally binding agreements. If you are under 18, you may use our services only with the involvement of a parent or guardian who agrees to be bound by these terms.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Your continued use of our services after changes constitutes acceptance of the modified terms.

Music Academy

Our music academy provides educational services including instrument lessons, vocal training, and music theory. Students must adhere to the academy's code of conduct, attendance requirements, and payment schedules. We reserve the right to dismiss students who violate policies or disrupt the learning environment.

Studio Services

Studio recording and rehearsal services are provided by appointment only. Users must respect equipment, follow studio rules, and complete payments as agreed. Any damage to equipment will be the financial responsibility of the user.

Live Music Band

Our live music band services are subject to availability and require advance booking. Contracts must be signed, and deposits paid to secure dates. Cancellation policies apply as outlined in individual booking agreements.

Sound Company

Sound and audio-visual services require detailed event specifications and technical requirements. We strive to provide professional service but cannot guarantee against technical failures beyond our control.

Merchandise Sales

All merchandise sales are final unless items are defective or incorrectly shipped. Returns must be requested within 30 days of purchase. Refunds will be processed to the original payment method within 7-10 business days.

Event Tickets and Registrations

Event registrations and ticket purchases are generally non-refundable unless an event is cancelled by Ewald Music. In case of cancellation, full refunds or credits toward future events will be provided.

Subscription Services

Any subscription-based services require recurring payments. Subscribers may cancel at any time, but no refunds will be provided for the current billing period. Cancellation takes effect at the end of the paid period.

Payment Methods

We accept various payment methods as indicated on our website. All prices are in the currency displayed at the time of purchase. You are responsible for any currency conversion fees charged by your bank or payment provider.

Ownership

All content on this website, including but not limited to text, graphics, logos, music, videos, and software, is the property of Ewald Music or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

Limited License

You are granted a limited, non-exclusive, non-transferable license to access and use our website and services for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

User-Generated Content

If you submit content (comments, reviews, testimonials, photos, or videos), you grant Ewald Music a worldwide, royalty-free, perpetual license to use, reproduce, modify, and display that content for promotional and operational purposes.

Music Rights

All music created, recorded, or distributed by Ewald Music is protected by copyright. Unauthorized use, distribution, or reproduction of our music is strictly prohibited and may result in legal action.

Acceptable Use

You agree to use our services in a manner consistent with all applicable laws and regulations. Prohibited activities include harassment, fraud, spamming, distributing malware, or any activity that could harm our systems or other users.

Account Security

If you create an account, you are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized use of your account.

Event Conduct

Participants in our events and programs are expected to conduct themselves respectfully and in accordance with Christian values. We reserve the right to remove individuals who disrupt events or violate our code of conduct.

Equipment and Facilities

Users of our studios, equipment, or facilities must treat all property with care. Any damage caused by negligence or misuse will be charged to the responsible party.

Service Availability

Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, timely, secure, or error-free.

Educational Outcomes

While we strive to provide quality music education, we make no guarantees about specific learning outcomes or skill development. Progress depends on individual effort, practice, and natural aptitude.

Equipment and Technology

We maintain professional equipment and technology but cannot guarantee against technical failures or equipment malfunctions. We are not liable for any losses resulting from such failures beyond refunding applicable service fees.

Limitation of Liability

To the maximum extent permitted by law, Ewald Music shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Maximum Liability

In no event shall our total liability to you for all damages exceed the amount you paid to us in the six months preceding the claim, or 100,000 XAF, whichever is greater.

Privacy Policy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these terms by reference. Please review our Privacy Policy to understand our data practices.

Consent to Communications

By using our services, you consent to receive communications from us via email, SMS, or other electronic means regarding your account, services, events, and promotional offers. You may opt out of marketing communications at any time.

Service Cancellations

Cancellation policies vary by service type. Please review the specific cancellation terms for your service:

• Music Academy: Withdrawal from classes requires 30 days notice. Tuition is non-refundable but may be credited toward future terms.
• Studio Bookings: Cancellations made 48 hours or more in advance receive full refund. Late cancellations forfeit deposit.
• Event Bookings: Cancellations made 30+ days in advance receive 50% refund. Cancellations within 30 days forfeit all payments.
• Workshops and One-Time Events: Refunds available up to 7 days before the event.

Ewald Music Cancellations

If Ewald Music cancels a service or event, you will receive a full refund or credit toward future services. We are not responsible for travel, accommodation, or other expenses you may have incurred.

Applicable Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Cameroon, without regard to its conflict of law provisions.

Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the parties agree to first attempt to resolve the matter through good faith negotiations. If negotiations fail, disputes shall be resolved through mediation or arbitration in Buea, Cameroon.

Jurisdiction

You agree that any legal action or proceeding shall be brought exclusively in the courts of the Southwest Region, Cameroon, and you consent to the personal jurisdiction of such courts.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and Ewald Music concerning your use of our services.

Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
